This Copyright Policy explains how we handle copyright infringement claims on our platform (www.leasebites.com, the "Platform"), outlines the procedures for reporting infringing content, and details how we respond to such notices. Users are expected to ensure that any content they upload, share, or otherwise make available on the Platform complies with all applicable copyright laws. If you believe that your copyrighted work has been infringed on our Platform, you may submit a complaint in accordance with this policy. Likewise, if you receive a copyright notice or believe that content you have posted was removed by mistake, this policy outlines how to respond.

1. Overview of LeaseBites’ Role and Responsibilities

1.1 Platform Functionality

LeaseBites provides an online platform that facilitates connections between Space Owners and Truck Owners for rental agreements. We allow users to post Listings, profiles, images, and other content (“User-Generated Content”) on the Platform. While we strive to monitor and enforce our content guidelines, LeaseBites does not pre-screen content before it is posted.

1.2 Copyright Compliance

It is our policy to respond promptly to notices of alleged copyright infringement that comply with the DMCA and to remove or disable access to infringing content. LeaseBites may, at its discretion, terminate the accounts of repeat infringers or take other actions as necessary to protect copyright owners.

2. What Is Copyright Infringement?

2.1 Definition of Copyright

Copyright is a legal right granted to the creator of an original work, giving the creator exclusive rights to use and distribute their work. This includes, but is not limited to, images, text, audio, video, graphics, software, and other creative content. Unauthorized use, reproduction, distribution, or display of such works without the permission of the copyright owner constitutes copyright infringement.

2.2 Examples of Infringement on the Platform

Common examples of copyright infringement include:

  • Uploading images, logos, or videos that you do not own or do not have the right to use.
  • Copying descriptions, promotional material, or other protected content from other sources.
  • Using licensed content in Listings without proper authorization.

3. Filing a DMCA Takedown Notice

3.1 DMCA Notice Requirements

If you are a copyright owner or an authorized representative and believe that content on our Platform infringes upon your copyright, you may submit a DMCA Takedown Notice. To be effective, your notice must include the following information:

  • Identification of the copyrighted work that you claim has been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works.
  • Identification of the infringing material that is claimed to be infringing or is the subject of infringing activity, and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., a URL link to the specific content).
  • Your contact information, including your full name, mailing address, telephone number, and email address.
  • A statement by you that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
  • Your physical or electronic signature (typing your full legal name at the end of your complaint is acceptable).

3.2 How to Submit a DMCA Takedown Notice

4. Responding to a DMCA Takedown Notice

4.1 Counter-Notification Requirements

If you believe that the content removed or disabled by LeaseBites was mistakenly identified as infringing or that you have the right to post it, you may submit a Counter-Notification. To be effective, the Counter-Notification must include the following information:

  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
  • Your contact information, including your name, address, and telephone number.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • A statement that you consent to the jurisdiction of the Federal District Court for the district in which your address is located, or if your address is outside of the United States, for any judicial district in which LeaseBites may be found, and that you will accept service of process from the person who provided the original DMCA Takedown Notice or an agent of such person.
  • Your physical or electronic signature (typing your full legal name at the end of your notification is acceptable).

4.2 How to Submit a Counter-Notification

You may send your Counter-Notification to our Designated Copyright Agent using the contact information provided in Section 3.2.

5. LeaseBites’ Response to DMCA Notices

5.1 Content Removal

Upon receiving a valid DMCA Takedown Notice, LeaseBites will promptly remove or disable access to the allegedly infringing content and notify the User who posted the content. The User may then choose to submit a Counter-Notification if they believe the content was removed in error.

5.2 Restoring Content

If we receive a valid Counter-Notification, we will forward it to the party who filed the original DMCA Takedown Notice. If no legal action is initiated within 10 business days, we may restore the removed content at our discretion.

6. Repeat Infringer Policy

LeaseBites has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, Users who are deemed to be repeat infringers. A repeat infringer is defined as a User who has been the subject of multiple valid DMCA Takedown Notices.

7. Misrepresentations and Legal Consequences

Any person who knowingly misrepresents that content is infringing or was removed by mistake may be liable for damages under the DMCA. LeaseBites reserves the right to seek damages from any party that submits a false DMCA Takedown Notice or Counter-Notification.

8. License to User-Generated Content

By posting content on the LeaseBites Platform, you grant LeaseBites a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, distribute, and display the content in connection with providing and promoting the Platform. You represent and warrant that you own or have the rights to all content you post and that the posting of such content does not violate third-party rights.

9. Changes to This Policy

We may update this Copyright Policy from time to time to reflect changes in our practices or for other legal or regulatory reasons. When we update this policy, we will revise the “Effective Date” at the top of this page. If the changes are significant, we will provide a prominent notice or seek your consent where required by law.
